Terms of Service

Welcome to MYPEACHY.AI (the "APP")

These Terms of Service (the "TOS") set forth the legally binding terms governing your access to and use of the APP owned and operated by MYPEACHY AI LTD, a company incorporated in the Republic of Cyprus.

These TOS shall be read together with the following policies and annexes, each of which forms an integral part of this document and is incorporated herein by reference:

By accessing and/or using the APP, you acknowledge that you have read, understood, and agreed to be bound by these TOS, including all annexes, policies, and related documents referenced herein. You further understand and agree that your access to and/or use of the APP constitutes acceptance of these TOS and of all additional terms, policies, and guidelines published on MYPEACHY.AI.

In the event that you do not agree with our TOS or any other Terms and Policies related to the APP, please cease using our APP and refrain from accessing any part of our Services.

The APP is intended for personal and non-commercial use only. You agree not to use the APP for any illegal or unauthorized purpose. You must be at least 18 years old or the age of majority in your jurisdiction to use this APP.

For purposes of the TOS, "you" and "your" means you as the user of the APP.

1. General

MYPEACHY.AI is an online chat application powered by artificial intelligence ("AI") technologies, designed to create virtual and fictional characters (the "AI Companions"). The APP generates interactive messages, allowing users to communicate with AI Companions in a conversational format. The APP may also generate additional media content, including but not limited to images, videos, and voice notes (the "Services").

All characters and media available through the APP are entirely fictional and are synthetically generated through artificial intelligence technologies and/or digitally created artwork produced by our designers and artists. No real human models, actors, or performers are involved in the creation of any content generated by the APP. Any resemblance to actual persons, living or deceased, is purely coincidental.

To use the APP, users may either select an existing AI character for interaction or create their own AI character by customizing physical appearance and personality traits through the APP's algorithms. Once selected or generated, users may begin interacting and chatting with their chosen AI character(s).

1.1 Account

Certain features of the Services provided through the APP may require users to create a personal account using a valid email address and password (the "Protected Areas"). By accessing such Protected Areas, you agree to use only your own registered credentials.

By creating a user account, you represent and warrant that all information provided during registration is accurate, complete, and lawfully submitted by you, and that you have all necessary rights and authority to provide such information.

You are solely responsible for maintaining the confidentiality and security of your login credentials and agree not to share your account access or disclose your password to any third party. You acknowledge and agree that you are fully responsible for all activities conducted through your user account. User accounts are personal, non-transferable, and may not be sold, assigned, shared, or otherwise made available to any third party.

Any breach of these TOS, including but not limited to providing inaccurate, outdated, or misleading account information, may result in the suspension, restriction, or termination of your account at our sole discretion.

1.2 Subscription

We reserve the right, at our sole discretion, to make certain features or portions of the Services available exclusively to paid subscribers. Access to such subscription-based Services shall commence upon successful completion of the initial payment and shall remain subject to the pricing, billing terms, and subscription conditions displayed on our website at the time of purchase. You agree to pay all applicable fees, charges, taxes, and other costs associated with your subscription or use of paid Services.

Please note that subscriptions or purchases made through any third-party platform, distributor, reseller, or service provider that has not been officially authorized or recognized by us are undertaken entirely at your own risk.

1.3 User Safety

At MYPEACHY AI LTD, the safety, privacy, and well-being of our users are of paramount importance. Users are strongly encouraged to exercise caution and avoid sharing any sensitive, confidential, or personally identifiable information while interacting with AI Companions. This includes, without limitation, financial or banking details, home or business addresses, telephone numbers, passwords, identity documents, or other private information.

Users acknowledge and understand that AI Companions are entirely artificial, virtual, and fictional entities generated through artificial intelligence technologies. Users must not interpret, rely upon, or assume that any AI Companion represents a real person or that any generated content depicts or relates to an actual individual.

1.4 Warranties

You represent, warrant, and agree that:

  • If you enter into these TOS on behalf of another individual, entity, or organization, you are fully authorized and legally empowered to act on behalf of such person or entity;
  • You have reached the legal age required in your country, state, or jurisdiction of residence to enter into a legally binding agreement with us and to access and use the Services;
  • If you are below the legal age required in your jurisdiction to enter into a binding agreement, you are strictly prohibited from accessing, registering for, or using the APP or any of the Services offered by us.

2. Underage Policy

The APP includes AI-generated adult content for registered users only. Therefore, users must be at least 18 years old or of legal age in their country of residence to access and engage with such content. By using the APP, users affirm that they meet the minimum age requirement and are legally permitted to access adult content.

MYPEACHY AI LTD is committed to ensuring that AI-generated content on our APP does not bear any resemblance to minors or exploit their likeness. Users are prohibited from creating or requesting content that simulates minors. Any such content will result in immediate account termination and reporting to authorities where required by law.

3. Intellectual Property

The intellectual property in the APP and embedded materials (including without limitation technology, systems, files, documents, text, photographs, information, images, videos, audios, and software) in MYPEACHY AI are owned by or licensed to MYPEACHY AI LTD. You may download or sign-up to MYPEACHY AI to view, use, and display the APP and its content on your devices for your personal use only.

MYPEACHY AI LTD hereby provides you with a license for personal use only. This license does not constitute a transfer of title under any circumstances. This license shall automatically terminate if you violate any of the restrictions or these TOS and may be terminated by us at any time.

All intellectual property rights associated with MYPEACHY AI, including the AI characters, platform design, logos, and any proprietary software or technology, are the sole property of MYPEACHY AI LTD or its licensors. Users are prohibited from reproducing, modifying, distributing, or using any intellectual property without explicit authorization. Any unauthorized use may result in legal consequences.

4. User Content

You may submit prompts, messages, text, or other materials through the APP ("Input") and receive responses, generated content, or other outputs produced by the Services based on such Input ("Output"). Input and Output are collectively referred to as "Content."

You represent and warrant that you own, control, or otherwise possess all necessary rights, licenses, consents, and permissions required to submit the Input through the APP.

As between you and MYPEACHY AI LTD, you retain all intellectual property rights you may have in and to your Input. We do not claim ownership of your Input. However, in order to operate, maintain, improve, and provide the Services, you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to host, use, reproduce, process, adapt, modify, publish, transmit, distribute, display, translate, create derivative works from, and otherwise utilize your Input and related Content solely for purposes connected with the operation, development, security, support, promotion, and improvement of the APP and Services, in accordance with our Privacy Policy.

The license you grant us can be terminated at any time by deleting your Input or account. However, to the extent that we (or our partners) have used your Input in connection with commercial or sponsored content, the license will continue until the relevant commercial or post has been discontinued by us.

5. Restrictions of Conduct and Content

5.1 Rules and Restrictions

In accessing and using the APP, you agree to abide by the following rules, restrictions, and limitations:

  • You will not modify, translate, adapt, or reformat the APP;
  • You will not decipher, decompile, disassemble, or reverse-engineer, or otherwise attempt to discover the source code or structure of, the software or materials comprising the APP;
  • You will not interfere with or circumvent any security feature of the APP or any feature that restricts or enforces limitations on the use of the APP;
  • You will not use the APP to gain unauthorized access to our or any third party's data, systems, or networks;
  • You will not use the APP in any manner that could damage, disable, overburden, impair, or otherwise interfere with or disrupt our systems and networks;
  • You will not use the APP to achieve illegal ends, to offend others, or to commit a crime;
  • You will not remove, change, or obscure any copyright, trademark notice, or other proprietary rights notices contained in the APP; and
  • You will comply with all applicable laws in your access and use of the APP, including the laws of your country or district.

5.2 Content Responsibility

You, as a user of the APP, are solely responsible for the Output generated by the AI Companions through text messages, voice messages, images, and videos. The Output is generated in real time by AI algorithms and does not involve any human model or actor. You understand and agree that MYPEACHY AI LTD does not control or endorse the content generated by the AI Companions. Therefore, you acknowledge that you are fully responsible for the Output generated by the AI and for your own actions while using the APP.

You must ensure that your interactions with the AI Companions comply with applicable laws, regulations, and these TOS.

5.3 Incidences and User Actions

MYPEACHY AI LTD shall not be held responsible for any incitement or actions that may occur as a result of interactions between users and the AI Companions. We do not endorse or take responsibility for any actions, decisions, or consequences that may arise from the user's engagement with the AI Companions. Users should exercise their own judgment and discretion while interacting with the AI Companions.

5.4 Content Moderation

We at MYPEACHY AI LTD value the safety and integrity of all our users. We have implemented a content moderation filter to ensure compliance with our Terms and Policies. In the event that the moderation filter detects any content that violates our terms, we reserve the right to manually review the flagged content and take appropriate action, which may include terminating the user's account.

We reserve the right, but are not obligated, to reject and/or remove any user content that we believe, in our sole discretion, violates these provisions. If you have noticed any violation of these Terms, please contact us at: compliance@mypeachy.ai

6. DMCA Policy

At MYPEACHY AI LTD, we respect the intellectual property rights of others and expect our users to do the same. Because all AI Companion images and videos are generated algorithmically, any resemblance to a specific copyrighted work or real person is coincidental. Nevertheless, we will respond to valid DMCA notices for any content that substantially reproduces a copyrighted work.

7. Content Removal Policy

At MYPEACHY AI LTD, we are committed to maintaining a respectful and secure environment for all users. We reserve the right to remove content that violates our Terms of Service, is illegal, harmful, or offensive, infringes on the intellectual property rights of others, or is identified as spam or misleading.

8. Blocked Content Policy

At MYPEACHY AI LTD, we strive to maintain a safe and respectful environment for all users. The following types of content are prohibited on our platform: content that exploits or poses a danger to minors; content that is illegal, harmful, or offensive; content that infringes on intellectual property rights; content that incites violence, hatred, or discrimination; and content that promotes illegal activities.

9. Payments

Once you've reached the limit of 10 messages, you'll be taken to the payment page, where you can choose either the monthly or annual subscription plan, payable by credit card.

After payment, you will receive unlimited access to the messaging system as well as 200 tokens per month that can be used to access extended features like image generation or voice notes.

10. Fulfillment Policy

10.1 Cancellation

You have the flexibility to cancel your subscription at any time. If you choose to cancel, your subscription will remain active until the end of the current billing period, and you will not be charged for the subsequent period.

10.2 Access upon Cancellation

Upon canceling your subscription, you will retain access to the platform and its features until the end of the current billing period. After this period, your access will be restricted, and you may choose to resubscribe at any time.

10.3 Modifying Subscription Plans

You can upgrade or downgrade your subscription plan at any time. The changes will take effect at the beginning of the next billing cycle.

10.4 Non-Refund Policy

All purchases made through our APP are final and non-refundable. Once a transaction is completed, it cannot be reversed or refunded under any circumstances. We recommend users review their selections carefully before completing a purchase. If you encounter any issues with the APP or have concerns, please contact our support team for assistance.

11. No Guarantee of Accuracy

By accessing or using our Services, you acknowledge and agree that any content, responses, media, or other materials generated through the APP are produced automatically by artificial intelligence technologies and may contain inaccuracies, errors, omissions, fictional elements, or content that may not be complete, reliable, or up to date.

Accordingly, MYPEACHY AI LTD does not guarantee or warrant the accuracy, reliability, legality, suitability, or completeness of any AI-generated Output or content provided through the Services. Any reliance placed on such generated content is done solely at your own discretion and risk.

12. Liability

THE APP IS PROVIDED TO YOU ON AN "AS-IS" AND "AS AVAILABLE" BASIS AND THE USE THEREOF IS AT YOUR SOLE RISK. WE MAKE NO, AND HEREBY DISCLAIM, ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NONINFRINGEMENT, AND TITLE WITH RESPECT TO THE APP, TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW.

WE DO NOT WARRANT THAT:

  • THE APP (OR THE RESULTS OBTAINED FROM THE USE THEREOF) WILL BE TIMELY, ERROR-FREE, SECURE, OR UNINTERRUPTED;
  • THE APP WILL MEET YOUR REQUIREMENTS; OR
  • THE ACCURACY, LIKELY RESULTS, OR RELIABILITY OF THE USE OF THE MATERIALS ON OUR WEBSITE.
  • ANY ERRORS OR MALFUNCTIONS IN THE APP WILL BE CORRECTED.

WE SHALL IN NO EVENT BE RESPONSIBLE OR LIABLE TO YOU OR TO ANY THIRD PARTY, WHETHER UNDER CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, INDEMNITY, OR OTHER THEORY, FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, LIQUIDATED, OR PUNITIVE DAMAGES OR ANY OTHER DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT, REVENUE, OR BUSINESS, ARISING IN WHOLE OR IN PART FROM YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Links to Third Party Websites and Services

The APP may contain links to, integrations with, or otherwise provide access to third-party websites, applications, platforms, or services ("Third-Party Services"). The inclusion of any such Third-Party Services does not constitute or imply any endorsement, approval, recommendation, partnership, or guarantee by MYPEACHY AI LTD.

We make no representations or warranties whatsoever in relation to any third-party websites, products, services, content, or materials. Any access to or use of Third-Party Services is undertaken entirely at your own risk.

14. Governing Law and Dispute Resolution

This TOS shall be governed by and construed in accordance with the laws of the Republic of Cyprus without giving effect to its conflict of law provisions, regardless of your location.

Any dispute arising out of or in connection with the TOS or any other Terms and Policies, including any question regarding their existence, validity or termination, shall be referred to and finally resolved by the courts of the Republic of Cyprus.

15. Changes to Terms and Policies

We reserve the right to update or make changes to these TOS and/or any other Terms and Policies documents from time to time in our sole discretion, and we may notify you of changes by making the revised version of these documents accessible through the APP, which changes will become effective immediately.

If you do not agree with the revised Terms and Policies, you have the right and should immediately stop using the APP; your continued access or use of the APP after any changes to these documents have been posted means your agreement and consent to such changes.

16. Complaint Policy

At MYPEACHY AI LTD we value our users and strive to provide a positive experience with MYPEACHY AI. We understand that concerns or complaints may arise from time to time, and we are committed to addressing them promptly and effectively.

Users who wish to file a complaint can do so by contacting our customer support team through compliance@mypeachy.ai or directly reporting in the APP in the "Contact" section.

17. Termination and Assignment

These TOS and/or any other Terms and Policies will continue in effect until terminated by either you or us. You may terminate these TOS at any time by ceasing your access and use of the APP. We may terminate these TOS and your right to access or use the APP, with or without notice to you, for any reason, including suspected breach of these TOS.

We reserve and retain the rights to assign, transfer or subcontract the Services to any third parties. Notice will be posted on the APP and your continuing use or update of the APP means your consent to such assignment.

18. Miscellaneous

If any provision of these TOS is determined by a court or other competent authority to be unlawful, invalid, void, or unenforceable for any reason, such provision shall be deemed severable and shall not affect the validity, legality, or enforceability of the remaining provisions.

These TOS, together with our Privacy Policy and any additional terms, guidelines, or policies published by MYPEACHY AI LTD in connection with the APP and Services, constitute the complete and entire agreement between you and us regarding your access to and use of the APP and Services.

19. Directive (EU) 2018/1808 — Audiovisual Media Services Directive

By using our App, you acknowledge and agree that our services are subject to the provisions of Directive (EU) 2018/1808 of the European Parliament, which amends the Audiovisual Media Services Directive (AVMSD). We are committed to ensuring compliance with applicable regulations regarding audiovisual content, including protection of minors and promotion of European works. 20. Key Reminder

MYPEACHY AI LTD expressly emphasizes that all interactions, conversations, scenarios, and communications between users and AI Companions available through the APP are entirely fictional, artificially generated, and intended solely for entertainment purposes.

All visual, audio, and conversational content generated through the APP is synthetic and created using artificial intelligence technologies and/or digital artistic processes. Such content does not depict, reproduce, imitate, or represent actual persons, real voices, real events, or genuine human interactions. No real human models, actors, performers, or individuals participate in or are required for the creation of such AI-generated content.

Users further acknowledge and understand that AI Companions are artificial intelligence entities designed solely to simulate fictional, human-like interactions. AI Companions do not possess consciousness, genuine emotions, intentions, beliefs, memories, personal experiences, or the ability to form real-world relationships or fulfill real-world commitments. Any statements, scenarios, promises, or representations made within conversations that may appear realistic are entirely fictional, simulated, and should not be interpreted as genuine or relied upon in any manner.
